Operating While Intoxicated
Penalties for OWI charges in Indiana depend on the individual’s blood alcohol content (BAC).
An OWI charge carries a minimum license suspension of 90 days for a first offense, a jail sentence of up to 60 days, and up to $500 in fines. A BAC below .15% incurs a Class C misdemeanor; A BAC meeting or exceeding .15% may carry a Class A misdemeanor.
Aggravating factors, such as a minor passenger or prior convictions, can increase the severity of the charge. OWI charges involving the death of another individual carries, at minimum, a Level 5 felony.
Specialized Driving Privileges
In certain instances, Indiana may grant a stay to individuals whose license has been suspended. This allocation may allow an individual to drive in order to fulfill employment or parental duties or maintain medical care. Drug Possession And Dealing
Indiana imposes harsh penalties on individuals charged with drug possession. Possession of less than 30 grams of marijuana is considered a Class A misdemeanor, and possession of cocaine, methamphetamine, heroin, or 30+ grams of marijuana carries a minimum of a Class D felony charge. Drug dealing carries similarly severe punishments, with most Schedule I, II and III drugs carrying a minimum of a Level 6 felony.
Expungements
Indiana law allows records in an individual’s criminal history file to be expunged. The state advises individuals seeking expungement to seek experienced counsel before filing a petition.
